  5. Is the landlord data used when assessing the size of the PRS for any of the following duties or purposes: Housing condition surveys to fulfil duties under s3 of the Housing Act 2004?
    In developing an overall housing strategy?
    Securing the effective implementation of HMO licensing under s55 of the Housing Act 2004?
    In considering making an HMO licensing designation under s56 of the Housing Act 2004?
    In considering making a selective licensing designation under s80 of the Housing Act 2004?
    Any other purposes?

Response
  1. We ask if the resident is the owner but there is no indicator for this on our systems

  2. Where the resident indicates they are not the owner we ask for details of the owner

  3. The name of the owner is recorded against the property and can be viewed by staff in Revenues and Benefits and Customer Services. The information can be shared with Housing staff where the property is empty.

  4. The information is collected for Council Tax purposes and shared as legislation allows.

  5. Housing condition surveys to fulfil duties under s3 of the Housing Act 2004? A Housing condition survey is currently being commissioned, which data sets to be used are being negotiated.
    In developing an overall housing strategy? The Housing Strategy is under review, the data sets to be used are still to be identified.
    Securing the effective implementation of HMO licensing under s55 of the Housing Act 2004? There are no additional licensing schemes in Eden.
    In considering making an HMO licensing designation under s56 of the Housing Act 2004? There are no additional licensing schemes in Eden.
    In considering making a selective licensing designation under s80 of the Housing Act 2004? There are no selective licensing schemes in Eden.
    Any other purposes? Identifying empty properties and who is an interested party. Provide supporting evidence that a property is an HMO.
