How trees are protected

We have statutory powers to protect trees that are of special amenity value. Several changes have been made to the legislation and the latest Regulations came into force on 6 April 2012.

Tree work on protected trees

Anyone wishing to do work on trees that are protected by a Tree Preservation Order (TPO), or are located within a Conservation Area, must obtain the appropriate consent. Sometimes a planning condition will also protect trees as part of a landscaping scheme and permission may be required from us before any work is carried out. There are some exceptions from this requirement to obtain permission or notify us, but if there is any uncertainty, it is best to seek advice from our Arboriculturist, or a professional adviser. The penalties for carrying out, or allowing unauthorised tree work, can be severe.

We also look after protected trees that are outside the Lake District National Park and the Yorkshire Dales National Park.

See overgrown trees and hedges for guidance and advice if they are causing a problem.

Contact the Arboriculturist for advice on protected trees within Eden District outside of the National Parks.
