- Councillor M Davidson declared that he had been lobbied in respect of item 8 (application no 10/0477) on the green papers.
- Councillor Fisher declared that he had received an email regarding item 1 (application no 10/0153) on the green papers and, when in business 11 years previously, had dealt with the father of the applicant on item 3 (application no 10/0523). Councillor Fisher also declared that he knew someone who lived adjacent to this application but that this did not compromise his ability to make a decision.
- Councillor Mrs Lumley declared that she knew the applicant of item 2 (Application no 10/0439) on the green papers as he was a distant relative.
- Councillor Patterson declared that he would speak on item 1 (application no 10/0153) on the green papers as Ward Member but also that he had a clear personal and prejudicial interest in item 10 (application no 10/0580) on the green papers and would leave the meeting.

RESOLVED that the application be REFUSED for the following reason:
- The proposal is part of a larger holiday let operation comprising Chapel Farm Caravan Park, which is already disproportionate to the scale and character of the hamlet of Little Asby and the proposal to intensify the use of this operation by the erection of a further holiday cottage, would bring harm to the character of the hamlet and the wider landscape and would conflict with the aims of relevant National and Local Planning Policy Guidance as outlined in PPS7, Cumbria and Lake District JSP Retained Policy EM16: Tourism and Eden Core Strategy Policy CS15: Tourism and the Visitor Economy.

RESOLVED that the application be REFUSED for the following reason:
- In the absence of the previously held exceptional and overriding affordable housing justification, the proposal as submitted would by reason of its siting, scale and detail have a detrimental impact upon the character of the existing street pattern, and result in a visual intrusion into the historical development pattern of the area and its relationship to the existing traditional development and open space evident on the northern approach to the adjacent bridge. The proposal would therefore be harmful to the street scene and the visual amenity of this part of the designated Conservation Area, contrary to Eden Core Strategy Policies CS17 "Principles for the Built (Historic) Environment" and CS18 "Design of New Development".

RESOLVED that the application be REFUSED for the following reason:
- As a result of the development that has taken place, unreasonable and unacceptable harm is caused to the privacy and amenity of the owners/ occupiers of the neighbouring property through overlooking, and this will not be alleviated by the proposed amendments to the structure proposed in this application. The development is therefore contrary to the aims and guidelines of Eden Core Strategy policy CS18: Design of New Development.
The meeting was adjourned at 11.35am for a short break before reconvening at 11.45am.

RESOLVED that the application be APPROVED subject to the following conditions:
- The development permitted shall be begun before the expiration of three years from the date of this permission.
- The development herby granted shall be carried out strictly in accordance with drawing numbers 109/150/01, 02B, 03D and 04C hereby approved and shall not be varied other than by prior agreement in writing by the Local Planning Authority.
- No power tools or machinery being used in connection with the training facility shall be operated on the site other than within the training room itself.
- Prior to the commencement of development approved by this planning permission (or such other date or stage in development as may be agreed in writing with the Local Planning Authority), the following components of a scheme to deal with the risks associated with contamination of the site shall be submitted to and approved, in writing, by the Local Planning Authority:
- A preliminary risk assessment which has identified:
- All previous uses
- Potential contaminants associated with those uses
- A conceptual model of the site indicating sources, pathways and receptors
- Potentially unacceptable risks arising from contamination at the site.
- A site investigation scheme, based on (i) above to provide information for a detailed assessment of the risk to all receptors that may be affected, including those off site.
- The site investigation results and the detailed risk assessment (ii) and, based on these, an options appraisal and remediation strategy giving full details of the remediation measures required and how they are to be undertaken.
- A verification plan providing details of the data that will be collected in order to demonstrate that the works set out in (iii) are complete and identifying any requirements for longer-term monitoring of pollutant linkages, maintenance and arrangements for contingency action.
Any changes to these components require the express consent of the Local Planning Authority. The scheme shall be implemented as approved.
- The development permitted by this planning permission shall only be carried out in accordance with the approved Flood Risk Assessment (FRA) from Tweddle and Slater and the following mitigation measures detailed within the FRA:
- No raising of ground levels within the flood plain.
- The use shall not be commenced until the access and parking requirements and pedestrian link, have been constructed in accordance with the approved plan. Any such access and or parking provision shall be retained and be capable of use when the development is completed and shall not be removed or altered without the prior consent of the Local Planning Authority.
- The whole of the access area bounded by the carriageway edge, entrance gates and the splays shall be constructed and drained to the specification of the Local Planning Authority in consultation with the Highway Authority.
- Prior to the use being commenced a scheme of car parking management detailing how the operators of the facility will actively promote the use of the overspill car parking area in order to minimise car parking within Derwent Close shall be submitted to and agreed by the local Planning Authority. The operator shall thereafter adhere to the agreed details.
- The training facility shall only operate between 08:00 and 17:00 hours on weekdays and shall not be operated at all at weekends or on bank holidays.
Reasons
- In order to comply with the provisions of the Town and Country Planning Act 1990.
- To ensure satisfactory development and to avoid any ambiguity as to what constitutes the permission.
- To safeguard residential amenity.
- To protect the quality of Myers Beck and groundwater resources.
- To ensure flood risk is not increased elsewhere as a result of the development.
- To ensure a minimum standard of access provision when the development is brought into use.
- In the interests of road safety.
- To minimise impact on neighbouring residents.
- To safeguard residential amenity.

RESOLVED that the application be REFUSED for the following reason:
- Insufficient information has been received by the Local Planning Authority to establish the need for a dwelling outside of a Key or Local Service Centre as defined in the Eden District Council Core Strategy Development Plan Document. As such, the proposal would be contrary to Policy NE1 and NE2 of Eden District Council Local Plan and Policies CS2, CS3 and CS7 Core Strategy Development Plan Document.

RESOLVED that the application be APPROVED subject to the following conditions:
- The development permitted shall be begun before the expiration of three years from the date of this permission.
- The development hereby granted shall be carried out strictly in accordance with the details and plans hereby approved (site plans and plan view received 2 July 2010, Topographic Survey plan and site plan received 6 August, elevation plans and tree planting plan received 20 September 2010) and shall not be varied other than by prior agreement in writing by the Local Planning Authority.
- The approved landscaping scheme shall be carried out within 6 months of the date of the first occupation of any building or completion of the development whichever is the sooner unless otherwise agreed in writing by the Local Planning Authority; any trees or plants/grassed areas which within a period of 5 years from the date of planting die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species and quality, unless the Local Planning Authority gives written consent to any variation.
