Pla/149/12/10 Declarations of Interest

  1. Councillor M Eyles and Councillor N Hughes declared personal interests in respect of application 10/0496 as one of the tenants of the units was the printer used by the Liberal Democrat party.

  2. Councillor J Thompson declared a personal interest in respect of application 10/0893 as he had known the applicant in her capacity as a local hairdresser.

Councillors N Hughes and M Eyles did not participate in the following item.

The Committee received a presentation from Councillor G Nicolson, who spoke on behalf of Councillor J M Holliday, as the Local Ward Member.

And RESOLVED that the Tree Work Application 10/0893 be REFUSED.

Reasons for decision

The extent of pruning detailed in the application was not in accordance with good pruning practice, would be detrimental to the health and appearance of the tree and would not significantly address the issues cited in the application.

And RESOLVED that:

Planning permission be granted subject to the signing of a Section 106 Agreement in respect of the provision of an acoustic barrier and the imposition of the following conditions:

  1. The development permitted shall be begun before the expiration of three years from the date of this permission

  2. The development hereby granted shall be carried out strictly in accordance with the details and plans hereby approved and shall not be varied other than by prior agreement in writing by the Local Planning Authority

  3. Prior to use on site the type of the stone cladding, external render and roofing slates to be used shall be submitted to and agreed with the Local Planning Authority. The development shall thereafter be carried out in accordance with those agreed details.

  4. A scheme of hard and soft landscaping shall be submitted to and agreed with the Local Planning Authority. The agreed scheme shall thereafter be implemented prior to first occupation of the flats.

  5. No development shall take place until a site investigation of the nature and extent of contamination has been carried out in accordance with a methodology which has previously been submitted to and approved in writing by the local planning authority. The results of the site investigation shall be made available to the Local Planning Authority before any development begins. If any contamination is found during the site investigation, a report specifying the measures to be taken to remediate the site to render it suitable for the development hereby permitted shall be submitted to and approved in writing by the local planning authority. The site shall be remediated in accordance with the approved measures before development begins. As a minimum standard after the permitted use commences the site should not be able to be determined as contaminated land under Part II A of the Environmental Protection Act 1990.

  6. The development shall be carried out strictly in accordance with the noise reduction measures which have been recommended by Appex Acoustics Ltd and which form part of the planning application.

Reason for the decision

It was considered that the benefits to the locality that the proposal would bring, outweighed the loss of this employment premises and the proposal therefore, subject to the imposition of conditions and the applicant entering into a Section 106 Agreement in respect of the provision of an acoustic barrier, be considered to be acceptable under these circumstances.
