Bankruptcy

If an arrangement fails or is not offered and the recovery team have information that an individuals outgoings far exceed there income bankruptcy may be considered. The first stage of this action requires that the Council serve a statutory demand on the customer. A formal petition is then taken before the County Court, in this case Carlisle. The customer is notified and given leave to defend the petition. If the petition is accepted the amount on the liability order is non recoverable. (As is all other debt owed to the authority) potentially up to the finacial year end.
