Attachment of Earnings

If a customer makes an arrangement which fails or does not offer to pay. The Council can attach their earnings by sending the necessary documentation Attachment of Earnings (PDF: 299Kb) to their employer. The employer must comply with the order by deducting a percentage of a persons earnings in line with legislation Example of Deductions to be made under Attachment of Earnings Order (PDF: 177Kb)

If the employer fails to comply with the order they commit an offence and the Council may prosecute in such a case.

An Attachment of Earnings order comprises of 3 copies. The white top copy is sent to the employer with a note stating that further information can be accessed on the council's website (Guidance Booklet for Employers (PDF: 103Kb) or a paper copy can be requested. The employer is asked to complete and return the confirmation slip (PDF: 5Kb) on receipt of the Attachment of earnings order, a prepaid envelope is also enclosed.

The pink copy of the Attachment of Earnings is kept and filed by the Council, and the blue copy is posted out to the employee with an explanation on the back about the Attachment Attachment of earnings order: duties of debtors (PDF: 373Kb) .

The employer has to apply the attachment of earnings as instructed and send the deducted money to the Council by the 19th of the following month. The Attachment of Earnings runs until the debt is cleared.
